What do people get wrong about the Latvia Digital Nomad Visa?

  • Underestimating timing by a factor of 2–3. The "60-day processing" line is real, but it's only the consulate's processing window. The door-to-door reality includes police clearance, apostille, consular appointment lead, and post-arrival registration, so most applicants land between 4 and 7 months.
  • Skipping or mis-formatting the apostille. Apostille is the single most cited rejection reason. Every supporting document from your home country needs an apostille from the right authority, and they expire. Don't apostille more than 4 months before submission.

Worth knowing: Latvia's remote work visa is not gated on nationality, it is gated on where the work is registered, and that is where a Brazilian file usually dies. PMLP requires the applicant to be employed by an employer established in an OECD member state, or to be self-employed and registered in one. Brazil is not an OECD member. It has been a Key Partner since 2007, the Council opened accession discussions on 25 January 2022 and adopted the Accession Roadmap on 10 June 2022, but the OECD publishes no deadline and membership has not happened. A Brazilian freelancer registered as an MEI or a Brazilian company billing Brazilian clients has no OECD tax administration that could issue the certificate PMLP names, so that person does not qualify at all. The qualifying case is a Brazilian national employed by a company registered in an OECD state, or one already registered and taxed in an OECD state. The compensating advantage is the border. Brazil sits on the Latvian MFA's visa-free list for ordinary passports, so a Brazilian enters Latvia and the rest of Schengen for 90 days in any 180 with no visa, and the D visa is a residence authorisation rather than the entry ticket. That matters more here than almost anywhere, because Latvia has no mission in Brazil and the alternative is Washington. Neither agreement exists: no double taxation treaty and no social security agreement between Brazil and Latvia, both confirmed from both sides.

How is Digital Nomad Visa income taxed for Brazilian citizens?

A confirmed special regime exists: under amendments to the Personal Income Tax law adopted on 28 June 2023 (in force retroactively from 1 January 2023), an OECD-state citizen or resident holding the Latvian digital nomad visa may elect a flat 15 percent PIT rate on Latvia-taxable income, available within 365 days of becoming a Latvian tax resident, instead of the standard progressive rates of up to 31 percent. Electing the 15 percent rate forfeits deductions and the non-taxable minimum/allowances. Otherwise standard residency rules apply: spending 183 or more days in Latvia within a 12-month period makes the holder a Latvian tax resident, taxed on worldwide income; under 183 days means non-resident status, taxed only on Latvia-sourced income.

What Brazilian tax still does

Brazil taxes on residence, not citizenship, but leaving does not end it by itself. Residency ends when you file the Comunicação de Saída Definitiva and then the Declaração de Saída Definitiva; skip them and the Receita Federal keeps assessing your worldwide income. Brazil has treaties with most of Europe, though not Germany, where the 1975 treaty has had no effect since 2006.

DNV holders who are OECD citizens get a 15% flat PIT for income earned within 365 days of becoming Latvian tax resident, with NO personal allowance and NO standard deductions; thereafter ordinary progressive rates apply (25.5% up to EUR 105,300, 33% above, plus a 3% solidarity surcharge over EUR 200,000). The reduced rate requires registering with the State Revenue Service and respecting double-tax-treaty residency rules. Residency generally triggered at >183 days.
